Terms of Service

These Terms of Service ("Terms") govern your use of empoweredrank.com (the "Site") and any engagement of Empowered Rank's services — the Growth Audit, the Pipeline Engine (Install + Run), and Fractional Head of Growth (together, the "Services"). By using the Site or engaging the Services, you agree to these Terms.

These Terms cover the general relationship between Empowered Rank and clients. A specific engagement — scope, price, and timeline — is confirmed separately with each client in writing (for example, a proposal, statement of work, or invoice) before work begins. Where anything in that written agreement conflicts with these Terms, the written agreement controls.

Services overview

Empowered Rank offers three ways to engage:

• Growth Audit — a one-time, paid diagnostic of your current acquisition system.
• The Pipeline Engine (Install + Run) — a fixed-price Install project followed by an ongoing monthly Run retainer covering paid campaigns (1–2 channels), landing pages, lead capture, tracking & attribution, basic nurture, and reporting.
• Fractional Head of Growth — ongoing embedded growth leadership, delivered on the same underlying system, billed monthly.

Scope of engagement

Each engagement's specific deliverables are defined at the time it's booked or contracted. As a general rule across all engagements, the following are outside scope unless explicitly agreed in writing as a paid add-on: full SEO/content engines, complete RevOps/CRM builds, sales hiring, brand or full website redesigns, organic social management, and PR. We'll flag anything outside scope as it comes up rather than quietly expanding an engagement.

Fees & payment

Fees for the Growth Audit are due at booking. Install fees are billed per the payment schedule agreed at the start of that project. Run and Fractional Head of Growth are billed monthly in advance, and continue until either party cancels per the notice period agreed in the engagement. Where a Growth Audit fee is credited toward Install + Run (per the 30-day credit terms described on our Pricing page), that credit is reflected on the first Install invoice.

Term & termination

Install is a fixed-scope project that concludes when the agreed deliverables are complete. Run and Fractional Head of Growth are month-to-month engagements; either party may cancel with the notice period stated in the engagement's written agreement (typically 30 days). Fees already paid for services already delivered are non-refundable.

Confidentiality

Each party agrees to keep the other's confidential business information — including campaign data, pricing, and internal materials shared during an engagement — confidential, and to use it only to perform the Services.

Intellectual property

Deliverables created specifically for a client as part of a paid engagement (campaign assets, landing pages, tracking configurations, and similar) belong to that client once fully paid for. Empowered Rank retains ownership of its own pre-existing methods, templates, and internal tools used to deliver the Services.

Warranties & disclaimers

We do our work to a professional standard, but marketing outcomes depend on factors outside our control (market conditions, your product, sales follow-through, and platform behavior among them). We do not guarantee specific results, rankings, revenue, or return on ad spend, except where a specific guarantee is explicitly agreed in writing for a given engagement.

Limitation of liability

To the fullest extent permitted by law, Empowered Rank's total liability arising from any engagement is limited to the fees paid for that engagement in the three months preceding the claim, and we are not liable for indirect, incidental, or consequential damages.

Governing law

These Terms are governed by the laws of the jurisdiction in which Empowered Rank is based, without regard to conflict-of-law principles.

Changes to these terms

We may update these Terms from time to time. The "Last updated" date above will always reflect the most recent version. Material changes affecting an active engagement will be communicated directly.
